Terms of Service

The legal agreement governing your use of the Createa Meme API.

Last updated: May 2026. This is a plain-English summary of binding terms. The terms below are the full agreement.

1. Who we are

The Createa Meme API ("the API", "Service", "we", "us") is operated by the entity behind createa.meme. By creating an account, generating an API key, or making a request to the API, you ("you", "Customer") agree to these terms.

If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" refers to that company.

2. Your account

  • You must provide a valid email and keep it current.
  • You are responsible for keeping your API keys secret. Treat a leaked key like a leaked password — rotate it from the dashboard immediately.
  • You must be at least 13 years old (16 in the EEA/UK).
  • One person, one account. Don't create multiple free-tier accounts to evade credit limits.

3. Acceptable use

You agree not to use the Service to generate, store, or distribute content that:

  • depicts minors in any sexual context (this is the absolute hard line — accounts that attempt this are terminated and reported to NCMEC);
  • targets a private individual with harassment, threats, or doxxing;
  • depicts a real person in a sexual, defamatory, or politically inflammatory context without their consent (no deepfakes of real people);
  • infringes a third party's copyright, trademark, right of publicity, or other intellectual property right;
  • promotes self-harm, suicide, or eating disorders in a non-recovery context;
  • promotes terrorism, mass violence, or illegal activity;
  • is intended to deceive voters, manipulate elections, or impersonate a public official.

You also agree not to:

  • attempt to bypass rate limits, credit caps, or our moderation filters;
  • use automated tools to create accounts or farm free credits;
  • resell raw API access without prior written agreement;
  • reverse-engineer the Service to build a competing product.

We may suspend or terminate accounts that violate this section, with or without notice, and we may report violations to law enforcement where required.

4. Content ownership and license

You own what you create. Captions, prompts, and uploaded images you submit ("Your Content") remain yours. AI-generated outputs ("Generated Content") are also yours to the maximum extent permitted by law.

You grant us a license to operate the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, modify (only as needed to render and serve the meme), and create derivative works of Your Content and Generated Content for the sole purpose of operating, securing, and improving the Service.

You can revoke that license by deleting the content from your account. We will stop serving it within 30 days, except where retained copies are required to comply with law.

5. AI-generated content disclaimers

You acknowledge that:

  • The U.S. Copyright Office has stated that purely AI-generated content is generally not eligible for copyright protection unless a human contributed sufficient creative authorship. Whether your generated meme qualifies is a fact-specific question we cannot answer for you.
  • The underlying models can produce outputs that are inaccurate, offensive, or coincidentally similar to existing copyrighted works. We do not warrant that any output is original, non-infringing, or fit for any particular purpose.
  • You are responsible for reviewing generated content before publishing or distributing it.
  • We use third-party model providers (OpenAI, Anthropic, xAI). Prompts you submit are sent to those providers under their respective terms; see our Privacy Policy for details.

6. Plans, credits, and billing

  • Free-tier credits reset on a monthly cycle and do not roll over. Paid-tier credits also reset monthly unless your plan states otherwise.
  • All fees are charged in advance via Stripe. Subscriptions auto-renew until cancelled.
  • You may cancel anytime from the dashboard; cancellation takes effect at the end of your current billing period.
  • We do not offer refunds for partial months or unused credits, except where required by law.
  • We may change pricing with 30 days' notice; changes apply to your next billing cycle.

7. Service availability

We aim for high uptime but make no specific SLA available on free or self-serve plans. The Service is provided "as is" and "as available". Scheduled maintenance, third-party model outages, or rate-limit downgrades may cause temporary degradation.

8. Indemnification

You agree to defend, indemnify, and hold harmless Createa Meme, its operators, employees, and affiliates from any claim, demand, loss, or damage (including reasonable legal fees) arising out of:

  • Your Content or Generated Content you produced through the Service;
  • your violation of these terms or any law;
  • your infringement of any third party's rights.

9. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our aggregate liability for all claims arising out of these terms is capped at the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $100.

If you believe content served through the Service infringes your copyright, send a DMCA notice to jaz@createa.meme including:

  1. your physical or electronic signature;
  2. identification of the copyrighted work;
  3. the URL of the allegedly infringing content;
  4. your contact information;
  5. a statement of good-faith belief that the use is not authorized;
  6. a statement, under penalty of perjury, that the information is accurate and you are authorized to act.

We will respond promptly and may remove the content while we evaluate.

11. Termination

You may terminate your account at any time from the dashboard. We may terminate or suspend your access immediately for material breach of these terms, suspected fraud, or where required by law. On termination, your right to use the Service ends; provisions that by their nature survive (ownership, indemnification, liability cap, governing law) survive.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved by binding arbitration in Delaware, except either party may seek injunctive relief in court.

13. Changes to these terms

We may update these terms from time to time. Material changes will be announced by email or in-dashboard notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
